QUESTION: My company is asking me about transporting a generator and some diesel fuel. I have been attempting to find the answer in the regs, but am a little confused.

The generator will need an overweight permit, as it is grossing 82,000 lbs. It is mounted on its own trailer, something like a typical dry-van trailer. The trailer/generator were manufactured together - it is all one unit. The 1,250 gal fuel tank is a permanent part of that unit.

If I transported the generator (and the tank was loaded with fuel) to the end-user site, would I have to placard this vehicle and everything that goes along with that requirement?

ANSWER: There are 2 interpretations for 173.220 that say any internal combustion engine attached to another piece of equipment, with fuel tanks attached, do not fall under the Hazmat Regulations. As long as the securement (and oversize/overweight permits) is good, there shouldn't be a problem. You can look at the interpretations for this on the PHMSA site. The interpretations we found were dated 09/26/2000 (RSPA 00-0002) & 11/02/1999 (RSPA 99-0172).
