PrePass RULES in ARIZONA

QUESTION: We have PrePass placarded fuel tankers and are getting green lights coming into Arizona. We have some Officers telling us that drivers do NOT need to stop if they have a green, and Port folks saying they DO have to stop. Can you clarify this?
ANSWER: The officers are correct in telling your placarded fuel tanker drivers they must still stop, even though they have received a green light from PrePass at the scales and ports of entry. Exceptions to the "green light-no need to stop" rule are listed by state on the PrePass website. All hazardous material loads must stop for inspection in Arizona, regardless of whether or not they get the green light.
QUESTION: Can PrePass be used by authorities to track my drivers for any reason?
My driver's logs didn't match the time frame from port-to-port on the PrePass. I don’t want them falsifying their logs, but I also don’t want anyone using PrePass for tracking anything on my drivers.
ANSWER: There is no evidence on the citation that PrePass was used. An 11hr violation would be a violation of too much driving time since his last 10hr break, which in this case is from 9:00 to 10:10 (only one hour and ten minutes).
We suggest you interview your driver thoroughly to find out exactly how he knows they used PrePass to write this violation. Also, after receiving your latest message, ATA called PrePass customer service at 800.773.7277 - Option 6 to find out exactly what the POEs see when a vehicle uses PrePass. They said the only items recorded on the port’s computer screen are:
- Carrier name
- Truck number
- Location
- Date
- Truck received a red or green light
- Weight, if scale equipped with weigh in motion feature
Given this information, we can't see how PrePass could have been used (especially from information collected at the Utah POE and then used at the Colorado POE) to spot a 1hr 10 min. violation of the 11 hour HOS rule.
The customer service rep also stated you could give them a call to talk to them if you wish. The number is listed above. If you do so, be prepared to give them your account number and the PrePass device number in question.
