CHALLENGING SAFESTAT via DataQ

QUESTION: One of our drivers was given a DOT Inspection violation in Texas that the owner wants to challenge. Where can he submit a challenge to this inspection? It is not yet on the SafeStat System so I don’t think the DataQ challenge can be used.
ANSWER: According to the FMCSA, if it’s not in their system yet (SafeStat), you should wait a little longer before using DataQ. That’s the only way to challenge an inspection, and ATA recommends challenging every violation with which you disagree. Also, do not confuse violations with "citations." If you were issued a citation, then you must abide by the dates listed on the citation.
QUESTION: Why am I getting no action on my moving violations? I am only challenging the ones that have been dismissed in the Courts.
ANSWER: The question you are asking should be asked to the Federal Motor Carrier Safety Administration (FMCSA). FYI - just because a violation has been dismissed in court, does not mean it will automatically be taken off SafeStat. To challenge the violation on SafeStat you must go through the DataQ link on the FMCSA site. To use DataQ, you must have your PIN number issued when you received your DOT number. If you do not have it, then you will need to write to FMCSA in DC to request another.
Under CSA 2010, it will be more important than ever to make sure all your recorded violations are valid, as all violations will affect your safety rating.
