Legislative Actions
The 2010 Session of the Arizona Legislature convened on Monday, January 11, with continuing questions on the deficit dominating much of the discussion since that date. After initial bill hearing deadlines, ATA is tracking or working 88 measures that have potential impact on the transportation industry. ATA Priority Bills: (Status as of 3.10.10)
HB 2300 - Would restrict trucks to the two right-hand lanes on highways with three or more lanes in each direction (passed House Transportation & Infrastructure Committee and House Rules Committee)
HB 2318 - Would mandate meal and rest breaks of at least one 30-minute meal break during any continuous 8-hour shift and one 10-minute rest period during any continuous 4 hours of labor (DEAD - did not receive hearing)
HB 2336 - Would authorize properly trained and certified pilot escort vehicle operators to perform traffic control under guidelines to be developed by Arizona Dept. of Public Safety, Dept. of Transportation and the heavy-specialized industry (passed House of Representatives; assigned to Senate Natural Resources, Infrastructure and Public Debt)
HB 2645 - Would authorized AZ Dept. of Transportation to enter into agreements with other government entities or with private sector entities for operation of rest areas (passed House Transportation & Infrastructure Committee and House Rules Committee)
HB 2718 - Would prohibit in motor carrier contracts the practice of shippers requiring that the carrier indemnify the shipper for the shipper's negligence, errors or unsafe practices (passed House Commerce Committee)
SB 1067 - Would prohibit driver of a motor vehicle from watching TV or other type of image display devices while the motor vehicle is moving, with exceptions that cover in-cab technology (passed Senate; ready for House)
SB 1138 - Would expand Arizona's "move over" law to include any stationary vehicle whose emergency lights are flashing (passed Senate; ready for House)
SB 1334 - Would create a nonmoving civil traffic violation to use a handheld cellular device or PDA to write, send or read written messages while operating a motor vehicle (pending in Senate)
SB 1372 - Creates a sales tax classification for a menu of services, including automotive services, warranty or service contracts and other intangible services
